1. Introduction & Acceptance
These Terms & Conditions govern your use of KlearPay's website and related services. By accessing or using the service, you agree to be bound by these terms.
If you do not agree, please do not use the service.
KlearPay is operated by KLOUDFIRST NEXTGEN SYSTEMS PRIVATE LIMITED.
2. Nature of service
Important - please read carefully: KlearPay is not a bank, is not an NBFC, does not provide loans, and does not provide regulated financial advice.
- KlearPay provides tools for repayment planning and calculation
- KlearPay helps you plan extra payments on your existing loans
- KlearPay does not disburse loans, hold funds, or provide financial advisory services
3. User eligibility
To use KlearPay, you must:
- Be at least 18 years of age
- Be legally capable of entering into contracts
- Provide accurate and truthful information
- Have a valid loan account with a recognized lender in India
4. User responsibilities
By using KlearPay, you agree to:
- Provide accurate loan details such as EMI, interest rate, and tenure
- Maintain sufficient account balance if enabling automated repayments
- Review repayment plans and projections before enabling automation
- Monitor your bank statements and loan account regularly
- Notify us of any changes to your loan terms
Important: Final responsibility for loan repayment remains with you. KlearPay is a tool to assist you, but you are ultimately responsible for ensuring payments are made correctly and on time.
5. Repayment & automation disclaimer
Important limitations:
- Repayment plans and projections are estimates only
- Actual savings depend on your lender's interest calculation method, timing of repayments, and bank policies
- Failed debits may occur due to insufficient balance or bank system issues
- Lender policies regarding part-prepayments may change
KlearPay is not responsible for bank delays, lender policy changes, missed interest benefits due to external factors, or any consequences arising from failed payment attempts.
6. No guarantee clause
KlearPay makes no guarantees regarding:
- Amount of interest savings
- Loan closure timeline
- Accuracy of projections (which are illustrative)
- Success of automated payment execution
All projections and estimates are for informational purposes only and should not be considered financial advice or guarantees.
7. Fees & pricing
Early access to KlearPay is free. We reserve the right to introduce subscription fees or other charges in the future. Any charges will be clearly disclosed in advance.
There are no hidden fees.
8. Suspension & termination
KlearPay may suspend or terminate your account if:
- You violate these Terms or our policies
- You provide false or misleading information
- You misuse the service
- Required by law or regulatory authorities
You may: delete your account anytime through contacting support.
9. Limitation of liability
To the maximum extent permitted by law, KlearPay shall not be liable for any indirect, incidental, special, consequential, or punitive damages.
- Loss of interest savings due to user actions or inactions
- Losses arising from bank system failures or delays
- Losses due to third-party payment gateway failures
- Any financial losses or damages related to loan repayment
10. Indemnity
You agree to indemnify and hold harmless KlearPay, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising from your use of the service, false information provided, or violation of these terms.
11. Intellectual property
All content, features, and functionality of the service - including the KlearPay website, branding, logos, and software - are owned by KLOUDFIRST NEXTGEN SYSTEMS PRIVATE LIMITED and protected by applicable intellectual property laws.
You may not copy, modify, distribute, sell, or resell any part of the service without express written permission.
12. Governing law & jurisdiction
These terms shall be governed by and construed in accordance with the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts of Mumbai, Maharashtra, India.
